We respect the work of photographers, writers and other creators, and we expect everyone who uses LakbayBook to do the same. This policy explains how to tell us that something on LakbayBook copies your work without permission, and what happens next. It is part of our Terms of Service.
It follows the Intellectual Property Code of the Philippines (Republic Act No. 8293). For people in the United States, it also works as our process under the Digital Millennium Copyright Act (DMCA).
1. What this covers
Anything a person adds to LakbayBook: review and memory photos, uploaded place photos, trip covers, hotel photos, written reviews, guides, and trip pages made public. Photos we show from other sources (for example free-licence photos with their credit) can be reported the same way.
2. Tell us about copied work
The quickest way, for a photo: open it, tap ⚑ Report and choose “Taken from someone else (copyright)”.
For anything else, or to send a formal notice, email [email protected] with the subject “Copyright notice” and include:
- Your name, and how to reach you (email, and a postal address or phone number).
- The work you own — a link to it, or a description we can check.
- Where it is on LakbayBook — the link to the trip, place or photo, and which photo or text.
- A statement that you believe in good faith the use isn’t allowed by you, your agent or the law.
- A statement that the notice is accurate and that you own the copyright or may act for the owner.
- Your signature — typing your full name is enough.
A notice missing these parts may take us longer, because we may need to ask you for them.
3. What we do
- We review each notice and, when it is complete and holds up, remove the material or block access to it.
- We tell the person who posted it, with the details of the notice (we may share your name and the work with them).
- A photo reported through ⚑ Report is checked by our team, who can hide it straight away while they look.
4. If your post was removed by mistake
If you believe something you posted was taken down by mistake, or that you had the right to use it, you can send a counter-notice to [email protected] with:
- Your name and how to reach you.
- What was removed and where it was.
- A statement, in good faith, that it was removed by mistake or misidentified, and why.
- Your agreement to the courts of the Philippines (or, if you are in the United States, the courts where you live) for any claim about it.
- Your signature — typing your full name is enough.
We pass the counter-notice to the person who complained. Unless they tell us within 10 business days that they have taken the matter to court, we may put the material back.
5. Repeat infringers
We close the accounts of people who keep posting other people’s work after we have removed it, and we may stop them making a new one.
6. Only true claims
Please only send a notice or counter-notice you believe is true. A false claim can harm the other person, and under the law of the Philippines and the DMCA you may have to pay for the damage it causes. If you are not sure whether a use is allowed (for example, a short quote in a review), you may want legal advice first.
7. Contact
